BIG BEAR RECOVERY DISCLAIMER & TERMS OF SERVICE

1. Assumption of Risk & Release of Liability

By requesting or participating in recovery, roadside assistance, or any other service provided by Big Bear Recovery (BBR), the customer acknowledges and accepts the inherent risks of off-road vehicle recovery. Customers and any bystanders voluntarily assume all risks, including but not limited to personal injury, property damage, or death, whether caused by terrain, weather conditions, recovery operations, or equipment use. BBR, its owners, employees, and affiliates are not liable for any injuries, damages, or losses incurred before, during, or after recovery operations.

If a customer chooses to assist or remain in the vicinity of the recovery, they do so at their own risk and waive any claim against BBR. Customers are strongly encouraged to stay at a safe distance from all recovery operations.

2. Vehicle Condition & Recovery Limitations

BBR does not guarantee that a vehicle will be undamaged during or after recovery. Off-road recoveries involve extreme conditions, and BBR is not responsible for broken parts, mechanical failures, or any pre-existing damage that may be affected or worsened by the recovery process. Customers assume full responsibility for their vehicles and any resulting damage that takes place from recovery efforts. BBR specializes in minimizing this with experience, training and equipment. 

BBR defines a recovery as assisting a stuck or unstable vehicle off the trail. Services such as jump starts, fuel delivery, tire changes or other addons are benefits accessed while a recovery is needed.   

Services to the Glamis area are not included in our response areas during the Imperial County Recreational area season time frames. This area is subject to approval at all times. 

3. Trail Repairs

BBR may perform trail repairs as part of a recovery effort. These repairs are temporary solutions intended to assist the vehicle in reaching a safer location or professional mechanic. BBR makes no warranty on any repairs, modifications, or solutions provided during recovery. Customers should have their vehicle inspected by a certified mechanic after any recovery or repair, and customer or subscriber assumes all liability when driving the vehicle. BBR recommends all recovered or repaired vehicles be trailered and out of service.

4. Subscription Terms & Conditions

Subscription benefits take effect three (3) days after purchase.

Subscription holders must be present at the time of recovery.

Fleet service add-ons include unlimited recoveries per month.

All addon services selected are included in a subscription package are fully covered during a "recovery" call-out.

If a recovery is needed, BBR will transport the vehicle back to the roadway where the customer can access their personal roadside assistance plan.

Standby time for non-subscribers is billed at $175 per hour, rounded up to the next full hour.

Subscribers have a one-hour grace period before additional fees apply.

Any skid steer (tracked vehicle) is not included in any subscription coverage. This resource is jointly operated with a third party and billed separately to the customer. during the use of this resource both the skid steer and BBR hourly rate applies. 

5. Payment & Fees

All call-out fees must be paid upfront.

Additional fees, if applicable, must be paid immediately after services are completed.

Non-payment or refusal to pay will result in the vehicle being held until full payment is made.

6. Video Recording, Media Use & Influencer Content

A. Recording for Documentation & Training

Big Bear Recovery (BBR) reserves the right to film, photograph, and document all recovery operations for safety, training, quality control, and legal purposes. Video recordings may be used to verify service completion, assess recovery techniques, and maintain accurate records. Customers acknowledge that recovery operations may be recorded, even if they are not personally visible or participating.

B. Social Media, YouTube & Influencer Content

By requesting service, customers acknowledge and agree that BBR may use video footage and images for marketing, influencer content, and monetization purposes, including but not limited to YouTube, social media platforms, promotional materials, and other media outlets. This content is used to showcase off-road recoveries, educate the public, and support BBR’s digital brand.

BBR retains full ownership of all media recorded during operations and has the exclusive right to edit, publish, and monetize footage. Customers waive any claim to privacy, compensation, royalties, or approval rights over published content.

If a customer does not wish to be personally featured in influencer content, they must notify BBR in writing before services begin. However, this does not prevent filming of the recovery operation itself.

7. Legal & Enforcement

This agreement is governed by the laws of the State of Arizona and is enforceable in Yuma County, AZ.

By accepting services from BBR, the customer agrees to these terms and waives any right to dispute charges or hold BBR liable for damages, injuries, or losses incurred during or after services.
